Mumbai, Friday, 25 July 2025 : Rather than one instance of tax fraud, a well thought out and plotted scheme organized on behalf of such things as taxes. The case became the biggest reported case of input tax credit (ITC) fraud in the state whose main suspect Nikhil Naresh Wale was arrested by the police. It is however revealed that the violator used new creative and skilful ways to earn tax rebates as high as Rs 20.20 crore. The officers have also been disturbed by the fact that the scheme is uniquely constructed.

Sham businesses Surya Enterprises

As per Goods and Services Tax Act, Wale founded the company Messrs Surya Enterprises on 8 September 2021. However, the company is purely a documentation company; there is no movement of goods and services whatsoever, but the company makes out fictitious ITC claims and enjoys bogus ITC.

Rs 17.03 crore of non-existing tax benefits, besides Rs 3.03 crore of wrongful entries
The extent of the offence has come to light through an official scrutiny of the registered premise where Wale has managed to create a false ITC of 17.03 crore, through fictitious companies, which are augmented by an aberrant value of Rs 3.03 crore entered on the GST statement with wrong information. There is no direct trade of services or goods behind these transactions.

Additional actions court decision

The Ulhasnagar first-class judge has also ordered context 1 to jail Nikhil Wale until 30 July 2025, which is the time to do a further investigation of the case.

Special Investigation Team launched a targeted campaign in pursuance of a directive given by the State Goods and Services Tax Department. This project will work against the flow of artificial invoice, false transaction and tax avoidance. Codirector of the investigation was Deputy Commissioner Yasmin Azim Molkar, who was authorized to work on the behalf of Deputy Commissioner (Investigation) of Mumbai.

The operation was closely grouped with Assistant Commissioner Santosh Londhe, Tax Officer Deepti Pilare, Sujit Kakkad, Santosh Khedkar, Investigation Inspector and Assistant as they joined Ms. Molkar in the operation.

Permanent surveillance in the state taxation

The state tax department through this operation has registered the fifth arrest of 2025-26. Henceforth, the administration intends to further enhance its checks on counterfeit invoice, fictitious turnover as well as illegal handover of input tax credit.
